For Temporary Seasonal Workers in the U.S.

An H-2A visa allows a foreign national entry into the U.S. for temporary or seasonal agricultural work. There are several requirements of the employer in regards to this visa. CAEP is able to coordinate H-2A visas for our Agriculture, Horticulture and Equine programs only.

CAEP requests that employers contact us prior to applying to host an H-2A worker to ensure they understand the process of hiring H-2A workers.

Resources for Employers using CAEP H Visa Programs

Understanding the process of the H2-A Program

  • Must be a temporary job- 10 months maximum
  • Employers set criteria for employee profile
  • Pay the Adverse Effect Wage Rate (AEWR)
  • Recruit local workers to protect American jobs (up to 50% of the job contract)
  • ¾ guarantee-provide work for at least 3/4 of a 40 hour work week 
  • Must provide housing
  • Pay for transportation and provide cooking facilities
  • Must have workers insurance or workers compensation
  • Employer must provide items to perform the work
  • Employer must pay all recruiting fees necessary to find or assist workers through the embassy
  • H2-A workers do not pay income taxes, social security or Medicare

Once CAEP receives a request from an employer to do an H-2A application, we will:

  • Submit the application to the Department of Labor
  • Advertise for employer
  • Submit the visa petition for the worker (form I-129)
